PeakMV provides AI-powered audio-to-video generation using proprietary technology and third-party APIs. Service is currently in BETA. Features may be modified, limited, or discontinued without notice. Maximum 4 projects per user during beta.
You warrant that you own all rights to uploaded audio or have obtained necessary licenses. You assume full liability for any copyright infringement or IP violations. PeakMV does not verify ownership. You retain ownership of uploaded content. You receive a license to use generated videos. PeakMV may use generated content for promotional purposes (with audio removed).
Credit-Based System: PeakMV operates on a credit-based payment model. You purchase credits in advance through our third-party payment processor (Stripe). Credits are stored in your account balance and deducted when you generate videos. Video generation does not directly charge your payment method - credits are deducted from your pre-purchased balance.
Pricing: Each video generation costs credits based on duration (typically $3-$30 depending on video length). Exact pricing is displayed before generation. You can purchase credits in preset amounts ($10, $25, $50, $100) or custom amounts ($3-$500). A pay-as-you-go option is available if you have insufficient credits for a specific video - you'll be prompted to purchase the exact shortfall amount.
Refunds: Credits are non-refundable once video generation begins. Unused credits remain in your account indefinitely (credits do not expire). Failed generations may receive credit refunds at our discretion. Pricing may change at any time, but existing credit balances are unaffected.
Prohibited: uploading copyrighted content without authorization, creating illegal/harmful/adult content, deepfakes, IP infringement, reverse engineering, automated abuse, reselling service. Violations result in immediate termination and potential legal action.
We respond to valid DMCA takedown notices. Repeat infringers will be terminated. False claims may result in legal consequences.
Content is processed by third-party services. We use industry-standard security but do not guarantee absolute security. You are responsible for backing up generated videos. We may delete inactive projects to manage storage. See Privacy Policy for details.
Services are provided "AS IS." PeakMV makes no warranties regarding reliability, accuracy, or specific outcomes. AI-generated content may be unpredictable and should be reviewed before use. We do not guarantee uninterrupted service, permanent storage, or compatibility.
To the maximum extent permitted by law, PeakMV's total liability shall not exceed fees paid by you in the prior 12 months. We are not liable for indirect, consequential, or punitive damages, loss of profits or data, copyright infringement claims, or third-party actions. You use the Service at your own risk.
You indemnify and hold harmless PeakMV from all claims, damages, and expenses arising from your use, uploaded content, Terms violations, or IP infringement.
We may suspend or terminate accounts for Terms violations, illegal activity, copyright infringement, or other reasons. Upon termination, unused credits are forfeited and non-refundable.
We may modify these Terms at any time without notice. Continued use constitutes acceptance of changes.
Binding Arbitration: Any dispute arising from these Terms or the Service shall be resolved through binding individual arbitration, except where prohibited by law. You and PeakMV agree to waive the right to trial by jury.
Class Action Waiver: You waive the right to participate in class actions, class arbitrations, or representative actions. Claims must be brought individually. This waiver applies to the maximum extent permitted by law.
If any provision of these Terms is found invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and remaining provisions shall remain in full force.
These Terms and our Privacy Policy constitute the entire agreement between you and PeakMV, superseding all prior agreements or understandings.
